Chen Yanwen, senior partner of Shanghai K-Insight Law Firm, graduated from East China University of Political Science and Law with a Bachelor’s Degree in Law, and from Fudan University with a Master’s Degree in Civil and Commercial Law. She has rich experience in civil trials and criminal and intellectual property cases. The cases she handled have produced positive social effect and have been reported by the People's Court Daily of the Supreme Court, Shanghai Law Journal and other media. She also focuses on theoretical research, and many of her papers and cases were published in national law research journals. She started to serve as a lawyer from 2016. Case Handling

1. In a share transfer project of a limited industrial company in Shanghai, she assisted each shareholder in clarifying their loan-debt relationship with the company; assisted in the second largest shareholder in convening a shareholders’ meeting as his attorney agent, in which she helped transform his identity from a dormant shareholder to a prominent shareholder so that he became the actual controller of the company; reconciled the interests of all shareholders and helped them reach an agreement so that the company finally restored normal operation.

2. In a sales contract dispute between an elevator company in Shanghai and a real estate development company in Shanxi, she acted as the attorney agent and got involved in the second instance stage. With her efforts, the court upheld the first instance judgment. In the execution stage, she communicated with the judge and accompanied relevant staff to freeze the house properties and bank accounts of the other company in Shanxi. All the outstanding payments were executed in the end.

3. In a labor dispute between a listed company and the former Head of the Legal Department, she acted as the attorney agent for the company and helped it win the labor arbitration, the first instance and the second instance. The court rejected the unreasonable requests made by the former Head of the Legal Department, including the request for the company to pay him year-end bonus and salary.

4. In a lease contract dispute between a catering management company in Shanghai and a management company in Shanghai, she got involved in the second instance phase as the attorney agent. Although the court of first instance ruled against her client (her client was ordered pay management fees to the other party, and the huge sum of lease deposit paid to the other party would not be refunded), she successfully made the court of second instance to amend the original judgment through evidence collection from and communication with related parties after accepting the entrustment. The court finally ordered the opposite side to return the lease deposit to her client.

5. In litigation filed by a famous software company against its former employees for plagiarism of the company's game software and establishment of a corporate game platform, she acted as the attorney agent for the company and worked to preserve the evidence of infringement before litigation. Through identifying the plagiarism of most of the source documents, she finally secured a positive result in favor of her client.
