Furthermore, the huge claims made by the 4 resigned employees gave case a demonstration effect. Ma Xiaomin responded cautiously with his solid legal knowledge and rich practical experience. The results of arbitration, first instance and second instance all favored his argument. In 2013, he was entrusted by Shanghai Yishiduo E-Commerce Co., Ltd., the operator of the famous e-commerce platform YHD.COM, to deal with the case of huge claims made by express delivery personnel on the company in Shenzhen. The case involved a series of practical issues, such as the judicial interpretation and amendment of the new Labor Contract Law, the change and conflict of the provisions of Shenzhen Special Economic Zone, the differences between regular employees and dispatched workers, and the application of different working systems. These also made it a case with huge demonstration significance. After arbitration, first instance and second instance, Ma Xiaomin’s argument was supported by the Arbitration Commission and the court. They finally won the lawsuit. The above cases and other cases dealt with by Ma Xiaomin have produced great impact and are often cited as classic cases in the industry, helping clients avoid huge losses.
